These terms govern your use of FitOps. Read them carefully before subscribing.
FitOps is an AI-powered business operations platform for fitness and personal training professionals. It automates client intake, generates exercise programs, and facilitates progress check-ins. FitOps is operated by FitOps / Timothy Brewster ("FitOps", "we", "us").
By creating an account or subscribing to FitOps, you agree to these terms. If you're using FitOps on behalf of a business, that business accepts these terms.
You are responsible for maintaining the security of your FitOps account and all activity under it. Do not share login credentials with unauthorized parties.
You are responsible for reviewing and approving every program FitOps generates before delivering it to a client. You are responsible for ensuring programs are appropriate for each client's fitness level, medical history, and goals. FitOps is a tool — you are the professional.
You must provide honest, accurate information about your fitness level, injuries, and health conditions during intake. Withholding material information about injuries or health conditions may result in inappropriate programming — the PT and FitOps cannot compensate for incomplete disclosure.
Founding Trainer Plan — $29/month, locked-in rate for founding members. Billed monthly. Your rate will not change for as long as you remain subscribed.
Auto-renewal — Subscriptions renew automatically each month. Stripe handles billing; FitOps does not store payment card details.
Cancellation — You may cancel anytime from your account settings or by contacting support. Cancellation takes effect at the end of the current billing period. No partial-month refunds are provided.
Failed payments — If a payment fails, we will retry it. After 30 days of failed payment, your account may be suspended and data may be deleted in accordance with our data retention policy.
Plan changes — You may upgrade or downgrade plans at any time. Downgrade takes effect at the next billing cycle; upgrade takes effect immediately and is billed on a pro-rated basis.
FitOps programs are AI-generated suggestions, not clinical prescriptions. FitOps does not hold a medical, physiotherapy, or clinical license and is not a covered entity under HIPAA.
Programs generated by FitOps are intended for generally healthy individuals assessed by their PT as suitable for exercise. The PT is solely responsible for:
FitOps shall not be liable for any injury, illness, or damage that results from PT delivery of a program that was not reviewed, was modified inappropriately, or was used for a client for whom it was not suitable.
Clients with known injuries, post-surgical conditions, cardiac concerns, or other special populations require assessment by a qualified healthcare provider before beginning any exercise program — FitOps or otherwise.
FitOps is a business tool, not a licensed medical or clinical service.
To the fullest extent permitted by law, FitOps and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of revenue, loss of clients, business interruption, or loss of data — arising out of or in connection with your use of FitOps.
Our total liability for any claim arising under these terms shall not exceed the total amount you paid to FitOps in the 12 months preceding the claim.
This limitation applies regardless of the form of action, whether in contract, tort, or otherwise, and even if we have been advised of the possibility of such damages.
FitOps, its design, branding, and software are the property of FitOps / Timothy Brewster. You may not reproduce, modify, or resell FitOps or its components.
Programs you generate using FitOps for your clients are your professional work product. FitOps does not claim ownership over programs created using the service.
You may not use FitOps branding to imply endorsement or affiliation without written permission.
FitOps uses third-party services to deliver its functionality:
Your use of these third-party services is governed by their respective terms and privacy policies. FitOps is not responsible for the practices of these providers.
You may terminate your account at any time through your account settings or by contacting us. We may suspend or terminate your access to FitOps if you breach these terms or use the service in a way that causes harm to FitOps, its users, or third parties.
Upon termination, your right to use FitOps ceases immediately. We retain the right to delete your data in accordance with our data retention policy.
